Terms and Conditions

Welcome to AStayNVacay ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website [yourwebsite.com] and any services related to booking, managing, or listing short-term and mid-term rental properties.

By using this website, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Eligibility

• You must be 18 years or older to use our platform.
• You must be legally able to enter into a binding contract.

2. Account Registration

• You may be required to create an account.
• You are responsible for all activities that occur under your login credentials.
• Provide accurate and complete information.

3. Rental Bookings

• A rental agreement is created when a booking is confirmed.
• The renter ("Guest") agrees to abide by the host’s property rules, checkout instructions, and community guidelines.

4. Payment Terms

• All fees (rental, cleaning, taxes, etc.) are due at booking unless otherwise stated.
• Payments are processed via [Stripe, GoDaddy, Quickbooks or PayPal].
• Prices and availability are subject to change before booking confirmation.

5. Cancellation and Refund Policy

• Cancellation policies vary by listing and are shown at checkout.
• Refunds, if applicable, are processed per the cancellation tier selected (Flexible, Moderate, Strict, etc.).

6. Guest Responsibilities

Guests must:

• Treat the property with respect.
• Comply with house rules and local laws.
• Leave the property on or before the scheduled checkout time.
• Refrain from unauthorized guests or parties unless stated otherwise.

7. Overstaying and Trespassing

Guests must vacate the property by the designated checkout time. Any guest who remains on the premises beyond their booking without the host’s written consent is considered to be trespassing.

WARNING: Overstaying is a violation of these Terms and may result in:

·  Immediate legal action

·  Removal by law enforcement under Los Angeles trespassing ordinances L.A.M.C. SEC 41.24 & PC 602L

·  Additional fees including but not limited to double nightly rates

8. Host Responsibilities

• Hosts must provide safe, habitable, and accurately listed properties.
• Hosts agree to honor confirmed bookings and respond to guest concerns promptly.

9. Prohibited Use

You agree not to:

• Use the site for illegal purposes.
• Misrepresent listings or bookings.
• Interfere with the security or proper functioning of the site.

10. Limitation of Liability

We are not responsible for:

• Any personal injury, loss, or damage during the stay.
• Acts or omissions of guests or hosts.
• Interruptions in service, third-party disputes, or property conditions.

11. Indemnification

You agree to indemnify and hold harmless AStayNVacay, its affiliates, employees, and partners from any claims or damages arising from your use of the site or services.

12. Governing Law

These Terms are governed by the laws of United States/State of California. Any disputes shall be subject to the jurisdiction of the courts located in City of Los Angeles.
